Common Questions About Notary Services
Some documents are more complex and require significantly more time for the notary to provide service. Examples of these documents include:
- Will for one person plus affidavit of execution
- Power of Attorney for one person

Please have your documents prepared and organized. If a signature is required, all signatories should be present and have proof of identity such as a government issued photo ID.
A notarized copy is often referred to as a certified copy. This is a copy of an original document that has been certified by a notary public to be a true and accurate copy of the original.
Generally, a notary public is an individual appointed and authorized by the provincial government to do such things as certify documents, witness signings as well as administer oaths and declarations.
A commissioner of oaths is appointed and authorized by the province to administer oaths, declarations and take affidavits. A notary public has broader authority as he or she can perform these duties as well as notarize copies of documents as a true copies of the original.
In general, a notary public will not give legal advice. However, if the notary is also a lawyer and has been retained in that capacity by the client, he or she may give legal advice.
In many instances notorization is legally required. Certain types of affidavits, real estate documents and powers of attorney may not be legally binding unless they are properly notarized. In other instances, private organizations and individuals may require notarization to to help ensure accuracy and avoid potential fraud.
Typically, a signatory can prove his or her identity with any current, government issued photo identification such as a driver’s license, military ID or passport.
US documents are generally accepted in most US transactions when notarized by a Canadian notary. However, whether it is accepted is the prerogative of the party accepting the document and in rare instances they may insist on a US notary.
